ELIGIBILITY: This promotion is open only to legal residents of the fifty United States and District of Columbia, who have reached the age of majority at time of entry. Void in Puerto Rico, and all other U.S. and foreign territories and possessions, and wherever else prohibited or restricted by law. Employees of Morey's Piers and their affiliates, subsidiaries, divisions, advertising and/or promotion agencies (collectively, "Sweepstakes Entities"), and their immediate families and household members are not eligible. CONDITIONS OF ENTRY: All entries will be submitted per the rules of the particular contest. Prizes can only be awarded to the person whose name is listed on the account. Entries generated by script, macro, robotic or by any other automatic or mechanical means are void. By participating, entrants agree to these Official Rules, including all eligibility requirements. Sponsor reserves the right to disqualify participants who violate these Official Rules or interfere with this Sweepstakes in any manner. If a participant is disqualified, Sponsor reserves the right to terminate that participant's eligibility to participate in the Sweepstakes. This Sweepstakes is subject to all federal, state, and local laws. Neither Sweepstakes Entities nor any service providers are responsible for incorrect or inaccurate transcription of entry information, or for any human error, technical malfunctions, lost/delayed data transmission, omission or failures of any network, computer equipment, web site or software, or any other error or malfunction, or late, lost or misdirected entries. Sweepstakes Entities are not responsible for any liability for damage to any computer system resulting from participation in or accessing or downloading information in connection with this promotion.
LIABILITY LIMITS AND INDEMNITY: By entering and/or participating, all entrants and winners, on behalf of themselves, their executors, heirs and assigns hereby: (a) release Sweepstake Entities from any and all liability, claims or actions of any kind whatsoever for injuries, damages or losses of any kind to persons or property, including death and bodily injury, which may be sustained in connection with the conduct or outcome of the promotion or the receipt, ownership or use or misuse of any prize awarded, (b) indemnify and hold harmless Sweepstakes Entities from and against any and all claims arising from the foregoing, and (c) indemnify and hold harmless Sweepstake Entities from and against any and all claims arising from the acts or omissions of entrant or winner. Under no circumstances will Sweepstake Entities be liable for punitive, incidental, consequential, or special damages (including lost profits) or any other damages in excess of actual out-of-pocket costs incurred (if any) not to exceed $50, but in no event will attorneys' fees be awarded or recoverable.
All federal, state, and local laws and regulations apply, and the Giveaway is void where prohibited.
Sponsor reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Giveaway should (in its sole discretion) a virus, bugs, non-authorized human intervention, fraud or other causes beyond its control corrupt or affect the administration, security, fairness or proper conduct of the Giveaway.
All claims, including but not limited to claims arising from participation, shall be brought exclusively in the Courts of the State of New Jersey located in Cape May County.
DISPUTES Except where prohibited, entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the District of New Jersey or the appropriate New Jersey State Court located in Cape May County, New Jersey; (b) any and all claims, judgments and awards shall be limited to actual out‐of‐pocket costs incurred, not to exceed $50, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (c) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out‐of‐pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New Jersey, without giving effect to any choice of law or conflict of law rules (whether of the State of New Jersey or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New Jersey.
GENERAL: This promotion is governed by U.S. law, subject to all federal, state, and local laws. The decisions of Sponsor are final with respect to all aspects of the promotion. The Sponsor reserves the right to verify eligibility qualifications of any winner. Except where prohibited, all disputes arising out of or connected with this sweepstakes will be resolved on an individual basis by binding arbitration subject to the rules of the American Arbitration Association. The foregoing shall not limit any party's right to seek injunctive or equitable relief in any court with jurisdiction over the parties or to bring qualifying claims in small claims court. If an in-person hearing is required then it will take place in Cape May County, NJ. The arbitrator's decision and award will be final and binding and judgment on the award may be entered in any court with jurisdiction. The invalidity or unenforceability of any portion or provision of these Official Rules or an Affidavit will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules or an Affidavit is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. If there is a discrepancy between these Official Rules and any other promotion materials, the Official Rules will control and govern this sweepstakes. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision.
